Atum Terms of Use

These terms are an agreement between you and ATUM, Inc., a Delaware corporation ("Atum", "we", "us"). They cover the Atum app and the website atum.digital. By installing or using the app, or using the site, you agree to them. If you don't agree, don't use Atum.

Services that use the Verify API or SDK are covered by the separate Atum Developer Terms.

Atum is a passport that helps services detect whether a real person is behind an account or an AI agent. The app builds the passport from your phone's history (nearby devices, motion, and minutes signed in the phone's secure chip). It does not use biometrics, documents or location. How we handle data is described in the Atum Privacy Policy, which is part of these terms.

Atum is in early access. Features may change, break or stop, and trust levels, counters and other numbers in the app are estimates.

You must be at least 18 years old and able to enter into a binding agreement. You may not use Atum if the law where you live forbids it, or if you are on a US sanctions list.

  • Your passport lives on your phone. The passport and its key belong to the phone that created them. If you delete the app or the passport, reset the phone or lose it, the key is gone and cannot be restored by anyone, including us. A new passport then starts from day one.
  • Keep it yours. Don't sell, rent, lend or transfer your passport or your phone's history, and don't let someone else's agent act for your passport.
  • Agents. You decide which agents may act for your passport and with what limits. You are responsible for what your agents do under the permissions you give, until you revoke them.
  • What a passport says. A passport shows that a phone has lived through real time, and how much. It is not proof of identity, age, citizenship or eligibility, and services decide for themselves what to do with it.

Don't:

  • fake, simulate or replay a phone's history, use emulators, cloud phones, device farms or modified copies of the app, or tamper with signatures, App Attest or Play Integrity;
  • create or run several passports to get around a service's limits, or help others do so;
  • interfere with Atum, other users' encounters, the Verify API or the blockchain contract, or probe them for vulnerabilities outside our security contact (hi@atum.digital);
  • reverse engineer the app, except where the law allows it despite this restriction, or where an open-source license allows it;
  • use Atum to track or harm anyone, or to find out who someone is, or to break any law.

We may mark a passport as not verified, limit it or block it if we reasonably believe these terms were broken. Services may see that status when they check the passport.

Atum writes fingerprints (Merkle roots) of all phones' minutes to a public blockchain. Once written, they cannot be changed or removed by anyone, including us. Atum does not control the blockchain and is not responsible for its availability, fees or forks. Using Atum doesn't require you to hold a wallet, tokens or cryptocurrency, and Atum does not offer any token.

Services that check your passport are independent of Atum. Their offers, such as free credits, trials, airdrops or rewards, are governed by their own terms. Atum doesn't guarantee that any service will accept your passport or give you anything.

The app is free for people. If we ever charge for something, we will tell you the price before you pay.

Atum, the app, the site and their design and content belong to ATUM, Inc. or its licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, under these terms and the rules of the App Store or Google Play. Open-source components, including the Atum SDK (Apache 2.0), are licensed under their own licenses.

If you send us feedback or ideas, we may use them without any obligation to you.

If you got the app from the Apple App Store:

  • these terms are between you and Atum, not Apple, and Apple is not responsible for the app or its content;
  • Apple has no obligation to provide maintenance or support;
  • if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation;
  • Apple is not responsible for addressing claims about the app, including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy or intellectual property claims;
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Google Play's terms also apply if you got the app from Google Play.

Atum is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that Atum will be uninterrupted, error-free, or will detect every fake or accept every real person.

To the extent the law allows, Atum will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, rewards or opportunities. Atum's total liability for any claim relating to Atum is limited to the greater of the amount you paid us in the 12 months before the claim and US $100.

Some places don't allow these limits. If you live in one of them, they apply only as far as the law allows. Nothing in these terms limits liability for fraud, for gross negligence or willful misconduct, or for anything else that can't be limited by law.

If you break these terms or the law, and that leads to a claim against Atum, you agree to cover our reasonable costs of that claim. This does not apply to consumers where the law forbids it.

You can stop using Atum at any time by deleting your passport and the app. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering Atum. When we can, we will give you notice in advance. Sections 5, 8 and 10–15 continue after the end.

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Disputes go to the state or federal courts in Delaware, and you and Atum consent to their jurisdiction. You may also bring a claim in small claims court where you live.

If you are a consumer in the EU, the UK or another country that gives you the right, you also keep the protection of the mandatory laws of your country and may bring a claim in its courts.

Before going to court, please write to hi@atum.digital so we can try to solve it, and give us 30 days to do so.

  • Changes. We may update these terms. For significant changes we will tell you in the app at least 14 days before they take effect, unless the change is required by law or for security. If you keep using Atum after that, you accept the new terms.
  • The whole agreement. These terms and the Privacy Policy are the whole agreement between you and Atum about the app and the site.
  • Severability and waiver. If a part of these terms can't be enforced, the rest stays in force. If we don't enforce a term right away, we can still enforce it later.
  • Assignment. You can't transfer these terms. We may transfer them in a merger, acquisition or sale of assets.
